Terms of Service

These Terms of Service ("Terms") govern your use of fotohinc.com, the Fotoh Store, and Fotoh, Inc.'s consumer products. By using the site or purchasing hardware, you agree to these Terms.

1. Who we are

Fotoh, Inc. is a California stock corporation, entity number B20260321874, incorporated July 15, 2026, with its principal office in Fresno, California. We are a for-profit company that builds software and hardware products serving the global Muslim ummah. qardon.org is a technology of Fotoh, Inc. — not a separate entity, not a nonprofit, not a 501(c)(3), and it will not seek that status. It records; it does not hold and does not own. Money committed through it never passes through a Fotoh bank account: it moves between the participants' own accounts, each in that person's own name. Where these Terms reference qardon.org (waqf records, qard hasan lending, Recovery claims), those services are governed by the qardon.org terms of service.

2. Fotoh Store purchases

All prices are in US dollars unless otherwise noted.
No Fotoh hardware is manufactured today. Nothing is in stock, checkout is not open, no order can be placed and no money is taken — so there is no lead time, no order status and no return, because there is no order. Each store page says so on its face.
The Mushaf Cover device takes an email for a waitlist and nothing else. No charge is made, no price is set and no ship date is promised; you will be told before anything is ever asked of you.
The prices shown on store pages are current design prices and are not final.
When Fotoh does begin selling hardware, these Terms will state the return period and the warranty before the first order is taken. They do not state either today, because there is nothing to return and nothing to warrant.

3. Sponsorships

Sponsorship of a masjid Hub is a purchase from Fotoh, Inc., a for-profit company. Fotoh issues no tax documents of any kind and makes no claim of deductibility.
Sponsorships fund hardware, installation, and operating support for a specific masjid. Fotoh, Inc. takes a reasonable operational margin to sustain the program.
Nothing is charged for a sponsorship today — there is no checkout — so nothing is held and nothing needs refunding. If a charge is ever taken, the refund terms will be stated here before it is.
Sponsorships do NOT create any rights, ownership, or governance role in the recipient masjid.

4. Software use

Live Athan, the Fotoh AI Companion (a separate product, not part of Live Athan), and other Fotoh software are provided "as is" without warranty. Prayer times computed on-device are accurate to within ±1 minute against astronomical references but are not legally guaranteed. You bear responsibility for your worship.

5. AI Companion limitations

The Companion AI is a research tool. It cites sources where possible and labels its own conclusions as AI conclusions. It does NOT replace a real scholar, lawyer, doctor, or financial advisor. For consequential decisions (medical, legal, financial, marital), consult a qualified human professional in your jurisdiction.

6. Limitation of liability

To the maximum extent permitted by law, Fotoh, Inc.'s total liability arising from your use of any product or service is limited to the amount you paid for that product or service in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages.

7. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts serving Fresno County, California.

8. Changes

We may update these Terms. Material changes will be communicated by email to registered users and prominently posted on this page. Continued use of the site or products after the change constitutes acceptance.
