Terms of Service

These Terms of Service ("Terms") govern your use of fotohinc.com, the Fotoh Store, and Fotoh, Inc.'s consumer products. By using the site or purchasing hardware, you agree to these Terms.

1. Who we are

Fotoh, Inc. is a Delaware corporation headquartered in Atlanta, GA. We are a for-profit company that builds software and hardware products serving the global Muslim ummah. qardon.org is an independent 501(c)(3) nonprofit that we technically support but do not own or control. Where these Terms reference qardon.org's services (donations, Qard Hasan loans, Recovery aid), those services are governed by qardon.org's own terms.

2. Fotoh Store purchases

All prices are in US dollars unless otherwise noted.
Most SKUs are special-order with a 4–8 week lead time. The product page indicates current lead time.
The Mushaf Cover device is currently available as a pre-order waitlist only. No charge is made at the time of reservation; final pricing will be announced at launch, and you will be notified before any charge.
Hardware comes with a 30-day return policy from delivery. Special-order configured systems (Fotoh Hub Studio) are non-returnable except for defect.
Limited 12-month warranty against manufacturing defects on all hardware.

3. Sponsorships

Sponsorship of a masjid Hub is a contribution to Fotoh, Inc. (a for-profit company), NOT a tax-deductible donation. Sponsorships are NOT routed through qardon.org and are NOT issued as 501(c)(3) receipts.
Sponsorships fund hardware, installation, and operating support for a specific masjid. Fotoh, Inc. takes a reasonable operational margin to sustain the program.
Sponsorships are non-refundable once a masjid has been assigned and hardware ordered.
Sponsorships do NOT create any rights, ownership, or governance role in the recipient masjid.

4. Software use

Live Athan, Companion AI, and other Fotoh software are provided "as is" without warranty. Prayer times computed on-device are accurate to within ±1 minute against astronomical references but are not legally guaranteed. You bear responsibility for your worship.

5. AI Companion limitations

The Companion AI is a research tool. It cites sources where possible and labels its own conclusions as AI conclusions. It does NOT replace a real scholar, lawyer, doctor, or financial advisor. For consequential decisions (medical, legal, financial, marital), consult a qualified human professional in your jurisdiction.

6. Limitation of liability

To the maximum extent permitted by law, Fotoh, Inc.'s total liability arising from your use of any product or service is limited to the amount you paid for that product or service in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages.

7. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts of Delaware.

8. Changes

We may update these Terms. Material changes will be communicated by email to registered users and prominently posted on this page. Continued use of the site or products after the change constitutes acceptance.
